Booking Terms and Conditions of Temporary Holiday Accommodation

Koolinda by the Bay, Broome WA

DEFINITION
“Booking” means the period for which you have paid to stay at the Property.

“Property” means Koolinda by the Bay, Broome WA (Koolinda), 1 Scott Street, Broome WA 6725, and all its fixtures, fittings and equipment.

“Management” means the owners and managers of the Property.

“Guests” means the persons who stay overnight in the Property during the Booking.

“Visitor” means a person a Guest permits to visit the property during the Booking.

ACCEPTANCE AND RESPONSIBILITY
Payment of the Deposit or signing this document constitutes acceptance of these Terms and Conditions.
CHECK IN/OUT
Check-in time is not before 3:00pm on the arrival date and check out time is not later than 10:00 am on departure date.
Late departure is subject to prior arrangement and availability.
Unless otherwise arranged, a late check-out fee of $50 will be applied to each half hour after the 10.00am departure time. This late check-out fee will be deducted from your credit card or bond.
Management will contact you prior to your arrival to confirm your arrival time.
PAYMENT
A 50% deposit of the total booking amount must be received within 2 days after the Booking is taken by Management. Bookings are not confirmed until this deposit is received.
Payment in full must be received no later than 60 days prior to your arrival or in full if your arrival is less than 60 days
Payments of the amount due must be received in Australian dollars net of any credit card surcharges.
Please ensure payments are made within the specific time limits or the Booking will be cancelled automatically without notice or liability to you.
Credit Card: We accept Visa and MasterCard. Please phone or email your details to our reservations team. Note: a 0.5% credit card fee will be levied to cover transaction costs associated with credit card payments.
Direct Deposit: Account details are as follows. Please use your booking number (at the top of this letter) as a reference and the surname under which the Booking is made:

Cash payments are not accepted.
CANCELLATION FEES
A cancellation fee will be applicable on whole or part cancellation of accommodation as follows:

A booking cancelled 6 months or more before the arrival date will incur no cancellation fee.
A booking cancelled 1-6 months before arrival will incur a cancellation fee of 30% of total rental.
A booking cancelled 1 to 4 weeks before arrival date will incur a cancellation fee of 75% of the total rental.
A booking cancelled within 7 days will incur a cancellation fee of 100%
SECURITY BOND
The Bond and Credit Card Authorisation form must be completed and provided to Management upon confirmation of your Booking.
$500 Bond is to be paid in full 4 weeks prior to the arrival date. The bond is refunded within 48 hours of the departure via direct debit to your chosen account.
Any damage, loss or expense incurred by Management as a result of your breach of these Terms and Conditions will be charged against the credit card. Examples include but are not limited to any breakages, damages or excess cleaning requirements beyond our standard cleaning charge of $1,100.00
If credit card details are not provided, then we require a refundable security bond of $2000. This must be paid 30 Days prior to the start of the rental period. As long as we find everything in order after a property inspection, no amount concerning the above will be charged and any bond monies will be returned by mail within 14 working days.
If Management feels the bond will be insufficient to cover damage done then Management will charge the Guest’s credit card, without prior notice, an amount deemed to cover costs within reason.
INSURANCE
We recommend that our guests take out Comprehensive Travel Insurance with a reputable insurance company to cover any unforeseen circumstances such as an accident or ill health, which may lead to the cancellation of your retreat at Koolinda and the incurred charges. (Outlined in Cancellation / “No Show” / Early Departures).
GUESTS’PROPERTY
Whilst staying at Koolinda, all your personal belongings, including vehicles, are your responsibility and not the responsibility of our Booking Manager or Owner. Please ensure that you lock Koolinda when out and about in Broome and at night time.
PARTIES AND FUNCTIONS
Either parties or functions are strictly prohibited.
Breach of this condition may result in immediate termination and eviction without refund and extra charges for security, cleaning, garbage removal, wear and tear, repairs etc.

NOISE
Please UNDERSTAND THAT KOOLINDA IS IN A RESIDENTIAL AREA SO WE REQUEST THAT YOU AND YOUR GUESTS DO NOT MAKE ANY EXCESSIVE NOISE.
Disturbance to our neighbours, including excessive noise, is prohibited and may result in termination and eviction without refund and extra charges may be made for security and other expenses.
Stereos will be turned off by 10pm on week nights and Sundays and 12 midnight on Friday and Saturday nights. If the police are called or neighbours complain, you will be evicted from the property with no refund of accommodation paid offered.
The owner or Management has the right to evict tenants from the property during their stay if it is deemed by the manager that the tenants are not looking after the property or have too many people either at or residing at the property.
GROUP SIZE
Koolinda is strictly set up for a maximum of 15 guests. This number is not to be exceeded. If our Booking Manager discovers that you have more than 15 guests, we will ask you to leave, forfeiting any refund.
LINEN AND TOWELS
We supply linen, pillows, blankets and towels, which must be left where supplied in the bedrooms or bathrooms on departure. Pool towels are included.

PETS
Pets are not allowed at the Property.

CHILD SUPERVISION
Children are prohibited from being on the upstairs decks (Level 1 and Level 2), by the swimming pool or in the Spa bath without adult supervision. From a safety perspective, please do not let your child(ren) climb the fence surrounding the pool. Please refer to Koolinda by the Bay’s House Rules.
YOUR OTHER RESPONSIBILITIES
You must comply with all Koolinda’s House Rules and all instructions from Management and the caretaker of the property concerning occupancy, property, health, safety and quiet enjoyment of Koolinda and our neighbours.
You are responsible for damage, breakages, theft and loss relating to the Property and any part of it during your stay. You must notify us of this immediately. Management may recover from you, repair and replacement costs (at Management’s discretion).
Before departure all food must be removed from fridges, all rubbish put in the appropriate council rubbish bins provided, and crockery and cutlery washed and packed away. The property must be left in a clean and tidy condition.
Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of exclusive rubbish etc. Should the cleaning fee be more than usual costs for cleaning the property, you will be charged the additional costs over and above the normal cleaning fee, which will be deducted from the security bond or charged to your credit card.
All furniture and furnishing must be left in the position they were in when you arrived.
The property should be vacated on time and secured. All windows and doors are to be locked. All keys must be returned to Management or as otherwise directed.
You are responsible for the safekeeping and replacement of accommodation keys.
Smoking is restricted to the outside of Koolinda. Please do not smoke inside the house. Please be aware that Koolinda is situated in a ‘high’ fire risk area. Careless discarding of cigarette butts is a hazard and presents a danger to our environment.
RIGHT TO REFUSE OR REVOKE A BOOKING
The Manager and the Owner reserve the right to revoke or refuse to honour any booking which may in the opinion of either party (and at sole discretion) be unsuitable for Koolinda. The owner has the right to cancel a booking at any given stage issuing a full refund to the tenant.
PROBLEMS OR COMPLAINTS
In the case of any problem or complaint, you must inform Management at the earliest opportunity so Management has the chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours.
Failure to follow this procedure may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have.

ARBITRATION
Should any dispute arise between the Manager and the Guest which cannot be mutually resolved, the matter will be referred to Arbitration by a single arbitrator agreed to by the parties. Failing agreement upon a single arbitrator, then a single arbitrator appointed by the President of the Real Estate Institute of Western Australia (Inc) shall act as a sole arbitrator in accordance with the provisions of the Commercial Arbitrations Act 1985 as amended and his/her decision shall be final and binding on the parties.

DECLARATION
I declare that I am over 21 years of age and that this booking is made in accordance with the above Terms and Conditions. I have read and understand Koolinda by the Bay’s House Rules. Furthermore, I agree to be held responsible for any and all charges due and payable on this holiday home booking and any excess charges required after my departure from the property. I agree to depart the property at 10:00 am on the vacate date unless otherwise specified. If I do not vacate by 10:00 am I will be charged a $50 per half hour late checkout fee from 10:10 am, which will be taken from my bond.
